ALC Empire Holdings, Inc., a corporation organized under the laws of the Republic of the Philippines, operating globally through its NuCDN Division (“NuCDN”, “we”, “us”, or “our”).
1. PURPOSE AND SCOPE
This Trust, Abuse & DMCA Policy (“Policy”) establishes NuCDN’s framework for:
Maintaining trust, transparency, and operational integrity
Addressing abuse, misuse, and malicious activity
Responding to copyright infringement and DMCA notices
Ensuring compliance with applicable Philippine, United States, European Union, and international laws
This Policy applies to all users, customers, content owners, and third parties interacting with NuCDN services.

In the event of a conflict, the Terms and Conditions shall prevail unless otherwise required by law.
3. TRUST AND COMPLIANCE COMMITMENT
NuCDN operates as a Philippines-based infrastructure and security provider serving customers globally. We are committed to:
Protecting customer data and privacy
Maintaining strong security controls and abuse prevention
Enforcing acceptable use and copyright protections
Acting transparently and responsibly
NuCDN complies with applicable data protection and cybersecurity frameworks, including the Philippine Data Privacy Act (RA 10173), the EU General Data Protection Regulation (GDPR), and relevant international standards.
4. DATA SECURITY AND ACCESS CONTROL
NuCDN implements administrative, technical, and physical safeguards, including:
SSL/TLS encryption for supported traffic
Network firewalls, DDoS mitigation, and intrusion detection
Malware scanning and traffic analysis
Strict role-based access to customer data
Customer data is processed solely for legitimate service, security, compliance, and operational purposes, as described in our Privacy Policy.
5. ABUSE AND MISUSE REPORTING
NuCDN strictly prohibits abuse of its infrastructure, including but not limited to spam, phishing, malware distribution, network attacks, or other violations of the Acceptable Use Policy.
5.1 Reporting Abuse
Suspected abuse or misuse may be reported to NuCDN’s Abuse & Trust Team:

Reports should include sufficient detail to allow investigation (e.g., IP address, domain, timestamps, logs).
5.2 Investigation and Response
NuCDN may, at its sole discretion:
Investigate reported activity
Block traffic or content
Suspend or terminate affected services
Escalate matters to law enforcement or regulatory authorities
NuCDN is not obligated to provide advance notice where immediate action is required to protect its network or customers.
6. COPYRIGHT AND DMCA COMPLIANCE
NuCDN respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws.
NuCDN operates as a neutral service provider and does not monitor customer content for copyright infringement absent a valid notice.
7. DMCA TAKEDOWN NOTICE REQUIREMENTS
To submit a valid DMCA Takedown Notice, the complainant must provide all of the following:
- Full legal name and contact information
- Identification of the copyrighted work claimed to be infringed
- Exact URL(s) or location(s) of the allegedly infringing material
- A statement of good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that the complainant is authorized to act
- A physical or electronic signature

Incomplete or invalid notices may be rejected without action.
8. COUNTER-NOTICE PROCEDURE
If content is removed due to a DMCA notice and the affected party believes the removal was the result of mistake or misidentification, a Counter-Notice may be submitted including:
- Name, address, and contact information
- Identification of the removed content and its prior location
- A statement under penalty of perjury that removal was a mistake
- Consent to jurisdiction of the courts of the Republic of the Philippines (or applicable local jurisdiction if legally required)
- Physical or electronic signature
Upon receipt of a valid Counter-Notice, NuCDN may restore access to the content unless the original complainant initiates legal proceedings.
9. REPEAT INFRINGER POLICY
NuCDN reserves the right to suspend or terminate accounts of users determined to be repeat copyright infringers, consistent with applicable law.
10. LIMITATION OF LIABILITY
NuCDN shall not be liable for any damages arising from the removal, blocking, or disabling of content pursuant to this Policy or applicable law, provided such actions are taken in good faith.
11. POLICY UPDATES
NuCDN may update this Policy at any time.
